By using X DESTINATION, you agree to be bound by these Terms. If you do not agree to these Terms, do not use X DESTINATION.

1. Age Requirements and Eligibility

If we discover that a user is under 16 years old:

• We will immediately terminate the account
• We will delete all personal data associated with the account
• We may report to appropriate authorities if required by law

Parents or guardians who become aware that their child has provided us with personal information without consent should contact us at info@xdestination.io.

2. Account Creation

To use X DESTINATION, you must create an account. You must provide accurate and complete information and keep your account information updated. You are solely responsible for the activity that occurs on your account, and you must keep your account password secure.

You agree to:

• Provide truthful and accurate information
• Maintain the security of your password
• Accept responsibility for all activities under your account
• Notify us immediately of any unauthorized use
• Not create more than one personal account
• Not share your account credentials with anyone

3. User Content

X DESTINATION allows you to upload, submit, store, send or receive content ("User Content"). You retain all rights in, and are solely responsible for, the User Content you create.

By uploading, submitting, storing, sending or receiving User Content through X DESTINATION, you grant us a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to use, reproduce, distribute, create derivative works of, display, and perform the User Content in connection with the Services and our business, including for promotional purposes.

You represent and warrant that:

• You own or have the necessary rights to share the User Content
• Your User Content does not infringe any third party's intellectual property rights
• Your User Content complies with our Community Guidelines

4. Community Guidelines and Acceptable Use

4.1 Prohibited Content

You agree NOT to upload, post, or share content that:

• Is illegal, harmful, threatening, abusive, harassing, defamatory, or invasive of privacy
• Promotes hatred, discrimination, or violence against individuals or groups
• Contains sexually explicit material or pornography
• Exploits or endangers minors in any way
• Contains viruses, malware, or harmful code
• Infringes intellectual property rights of others
• Contains spam, advertising, or solicitations
• Impersonates any person or entity
• Violates any applicable law or regulation

4.2 Prohibited Behavior

You agree NOT to:

• Harass, bully, stalk, or intimidate other users
• Attempt to gain unauthorized access to accounts or systems
• Interfere with or disrupt the Services
• Circumvent security or authentication measures
• Use bots, scrapers, or automated tools without permission
• Collect personal information of other users without consent
• Use the Services for any fraudulent or deceptive purpose

5. Content Moderation and User Safety

5.1 Content Filtering

X DESTINATION employs automated and manual content filtering systems to detect and prevent the distribution of objectionable or inappropriate content, including but not limited to:

• Pornographic, sexually explicit, or obscene material
• Content that promotes hatred, violence, discrimination, or terrorism
• Content that exploits or endangers minors
• Harassment, threats, bullying, or intimidation
• Spam, scams, or fraudulent content
• Content that infringes intellectual property rights
• Any other content that violates applicable laws or these Terms

Content flagged by our filtering systems may be automatically removed or held for manual review before being published.

5.2 Our Right to Moderate

We reserve the right, but are not obligated, to:

• Monitor, review, and moderate all User Content
• Remove or disable access to any User Content that violates these Terms, at any time and without prior notice
• Suspend or permanently terminate accounts that violate these Terms
• Report illegal content to law enforcement authorities

5.3 Reporting Offensive Content and Users

If you encounter content or behavior that you believe violates these Terms or our Community Guidelines, you can report it through the following methods:

• In-App Report: Tap the "Report" button available on any content (photo, video, memory, moment, comment) or on any user profile
• Email: Send a detailed report to info@xdestination.io

5.4 Blocking Abusive Users

X DESTINATION provides tools to protect yourself from abusive users:

• Block User: You can block any user directly from their profile or from any content they have posted. Blocked users cannot view your profile, send you messages, or interact with your content
• Mute User: You can mute users to hide their content from your feed without fully blocking them
• Restrict Interactions: You can limit who can comment on your content or send you messages through your privacy settings

When you block a user:

• Their content is immediately removed from your feed
• All existing interactions between you and the blocked user are hidden
• The blocked user cannot contact you through the App
• Our team is automatically notified of the block, and we review the blocked user's activity to determine if further action (including account suspension) is necessary

5.5 Enforcement Actions

Depending on the nature and severity of violations, we may take one or more of the following actions:

1. Warning: A formal notice informing the user of the violation
2. Content Removal: Immediate removal of offending content from the platform
3. Temporary Suspension: Account access restricted for a defined period
4. Permanent Termination: Complete and irreversible account removal
5. Legal Referral: Reporting to law enforcement for illegal activity

Repeat offenders will face escalated enforcement, up to and including permanent account termination.

5.6 Appeals Process

If you believe your content was removed or your account was suspended in error:

1. Email info@xdestination.io within 30 days
2. Include your username and explanation of why you believe the action was incorrect
3. We will review your appeal within 7 business days
4. Our decision on appeals is final

6. Intellectual Property Rights

X DESTINATION and its entire contents, features, and functionality (including but not limited to all information, software, text, displays, images, video, and audio, and the design, selection, and arrangement thereof), are owned by X DESTINATION, its licensors, or other providers of such material and are protected by international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.

These Terms permit you to use X DESTINATION for your personal, non-commercial use only. You must not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any of the material on X DESTINATION, except as follows:

• Your device may temporarily store copies of such materials in RAM incidental to your accessing and viewing those materials
• You may store files that are automatically cached by your browser for display enhancement purposes
• You may print or download one copy of a reasonable number of pages for your own personal, non-commercial use

7. Copyright Infringement and DMCA

7.1 DMCA Notice

If you believe that your copyrighted work has been copied in a way that constitutes copyright infringement, please provide our Copyright Agent with the following information:

1. A physical or electronic signature of the copyright owner or authorized agent
2. Identification of the copyrighted work claimed to have been infringed
3. Identification of the material that is claimed to be infringing, including its location on our Services
4. Your contact information (address, telephone number, email)
5. A statement that you have a good faith belief that use of the material is not authorized by the copyright owner
6. A statement, under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorized to act on their behalf

7.2 Counter-Notice

If you believe your content was removed by mistake or misidentification, you may submit a counter-notice containing:

1. Your physical or electronic signature
2. Identification of the material that was removed and its former location
3. A statement under penalty of perjury that you have a good faith belief the material was removed by mistake
4. Your name, address, telephone number, and email
5. A statement that you consent to the jurisdiction of the federal court in your district and will accept service of process from the complaining party

7.3 Repeat Infringers

We will terminate the accounts of users who are repeat infringers of intellectual property rights.

8. The Content of Others

X DESTINATION allows you to access and use content that is owned or licensed by other users, advertisers, and other third-party providers. You understand and agree that:

• X DESTINATION does not control, endorse or assume responsibility for any content made available through the Services
• X DESTINATION makes no guarantee regarding the reliability, accuracy, legitimacy, or quality of any content
• You access and use any content at your own risk
• X DESTINATION is not responsible for any losses or damages incurred as a result of your use of any content

9. Safety

X DESTINATION is committed to providing a safe and secure environment for all users. You agree to:

• Not use the Services to engage in any activity that could result in harm to yourself or others
• Not distribute or promote any illegal or harmful activities
• Not post content that contains threats, hate speech, or incites violence
• Not engage in any form of harassment or bullying
• Not solicit personal information from any user under the age of 18
• Not engage in any fraudulent or deceptive activity

X DESTINATION reserves the right to investigate and take appropriate action against any user who violates these Terms, including reporting to law enforcement.

10. Your Account

You may delete your account at any time by following the instructions in Settings or by contacting us. If you delete your account:

• Your User Content will be deleted within 30 days
• Some information may be retained for legal or legitimate business purposes
• Content you shared with others may remain visible to them

We may suspend or terminate your account without prior notice if:

• You violate these Terms or our Community Guidelines
• We are required to do so by law
• Your account poses a security or safety risk

11. Payment and Xcoins

11.1 Virtual Currency

X DESTINATION may offer virtual currency ("Xcoins") that can be used within the Services. Xcoins:

• Have no monetary value and cannot be redeemed for cash
• Are non-transferable and non-refundable
• May expire if your account is terminated
• May be modified or discontinued at our discretion

11.2 Purchases

All purchases are final and non-refundable except as required by applicable law. By making a purchase, you authorize us to charge your payment method.

12. Indemnity

You agree to indemnify and hold X DESTINATION, its affiliates, officers, agents, employees, and partners harmless from any and all claims, damages, expenses, and liabilities (including reasonable attorneys' fees) arising out of or in connection with:

• Your use of the Services
• Your User Content
• Your violation of these Terms
• Your violation of any rights of another person or entity

14. Dispute Resolution and Arbitration

These Terms and any dispute arising out of or in connection with these Terms shall be governed by and construed in accordance with the laws of Italy.

Any dispute, controversy or claim arising out of or relating to these Terms, or the breach, termination or invalidity thereof, shall be settled by arbitration in accordance with the rules of the International Chamber of Commerce (ICC) by one or more arbitrators appointed in accordance with the said rules.

The place of arbitration shall be Milan, Italy, and the language of the arbitration shall be English or Italian. The award rendered by the arbitrator(s) shall be final and binding.

15. Termination

We may terminate or suspend your access to X DESTINATION and/or the Services, without prior notice or liability, for any reason whatsoever, including without limitation if you breach these Terms.

Upon termination:

• Your right to use the Services will immediately cease
• We may delete your account and User Content
• Provisions that should survive termination will survive (including indemnification, disclaimers, and limitations of liability)

16. Changes to Terms

We reserve the right to modify these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect.

Material changes will be communicated through:

• Email to your registered address
• In-app notification
• Updated date on this page

Your continued use of the Services after the effective date of the revised Terms constitutes your acceptance of the changes.

17. General Provisions

17.1 Entire Agreement

These Terms, together with our Privacy Policy and Community Guidelines, constitute the entire agreement between you and X DESTINATION.

17.2 Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.

17.3 No Waiver

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.

17.4 Assignment

You may not assign or transfer these Terms without our prior written consent. We may assign these Terms without restriction.
